1. Terms and conditions of sale

Protection of minors: minors do not have the capacity to contract and any collection of data must be subject to the agreement of the parental authority who may object to their conservation and / or transmission to third parties.

Validity period:
offers on the site are valid during their presence online and according to the quantities available in stock. We make every effort to ensure that our products and services give you complete satisfaction.
Validation :
Any order supposes the preliminary catch of knowledge, the integral acceptance and without reserve of the present general conditions of sale which can be called into question only in the cases limitativement envisaged in the present contract. Thus when you click on validate after the process of order, you declare to accept this one as well as the entirety of the general conditions of sale completely and without reserve.
Availability and execution:
The processing and preparation of shipments are generally made within 48 hours after receipt of the order and full payment.
- Upon receipt of your order, we check the availability of the product(s) ordered. In case of unavailability, we commit ourselves to proceed to no collection.
- The date of validation of the order corresponds to the date of collection of your payment.

The ordered products will only be shipped once the payment title is received and cashed.

2. Prices and Special Offers

Product prices:
The price applicable to the product ordered is the one appearing on the present site on the day of the order of the product(s) considered.
Our prices are displayed inclusive of tax and are calculated from our winery.
The prices can be modified without notice of our share and can be subjected to the variation of the conditions imposed by our suppliers, independently of our will.
The seller retains full and exclusive ownership of the products sold until full payment.

The trader is automatically liable to the consumer for the proper performance of the obligations arising from the distance contract, whether these obligations are to be performed by the trader who concluded the contract or by other service providers, without prejudice to his right of recourse against them. (Art. L. 121-20-3 of the Consumer Code) However, he may be exempted from all or part of his liability by proving that the non-performance or improper performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.

3. Shipping and delivery / transport

We deliver in Metropolitan France, in the DOM, TOM, countries of the European Union, in Norway and in Switzerland; the products are deliverable to the address stipulated by the customer.
From 250,00 € HT of purchases, the delivery is offered in METROPOLITAN FRANCE exclusively.
For deliveries outside Metropolitan France, we ask you to contact us to order in quantity.

Transfer of risks:
In case of damage or missing, make any necessary observation on the transport documents and confirm its reserves by registered letter with acknowledgment of receipt to the carrier within 48 hours after receipt of goods according to Articles 105 and following of the Commercial Code. In case of nonconformity of the delivered products, the salesman commits himself refunding or exchanging the product(s) to his customer as soon as possible. No responsibility of SARL PERCEVAL PASCAL could be retained because of the delay occurred in the delivery because of events independent of its will such as the delay because of the conveyor (the date of deposit of the products to the conveyor being taken as proof): strikes, stop of the means of transport, administrative decision or any other case of major force which would have for effect to delay or prevent the delivery

4. Guarantees

Exchange or return: Any returned item will be taken into account on the condition that it arrives to us in its original packaging, including the protective materials possibly inside the main packaging. (Law Article L121-16 of January 6, 1972)
For all operations of distance selling, the consumer has a period of 7 working days from the date of delivery of his order, to return any item that does not suit him and ask for an exchange or refund without penalty, except for return costs.
The exercise of the right of withdrawal obliges the seller to reimburse the sums paid by the buyer within a period less than or equal to 15 days after receipt of the product in the company.
For any returned item that you have paid for, we will reimburse you the value of the item, including shipping and return costs, unless the product is returned for a reason that is the responsibility of SARL PERCEVAL PASCAL, in which case SARL PERCEVAL PASCAL will reimburse you for the product as well as the shipping and delivery costs that you have been charged.

8. Limitation of Liability.

The responsibility of : SARL PERCEVAL PASCAL concerning the sales will be limited to the purchase value of the goods by the cocontractor.
From Monday to Friday from 8am to 12pm to 2pm to 6pm.
Competent jurisdiction: the conditions of sale are governed by the French law. All disputes that may arise between the parties concerning, among other things, the validity, interpretation, execution or termination of the contract shall be finally settled by the competent court of CHAMBERY 73000.
